In today’s shifting sands of technology and antitrust wars, a single courtroom ruling can have repercussions that extend well beyond the parties involved. This point was driven home last week after Google cruised to a pretty big victory in court, which has—ironically—turned out to be a huge win for its long-time rival and occasional ally, Apple.

While it looks like a win for one tech giant, it has, in fact, now spared the other from what could have been an economically burdensome and protracted legal storm. Let’s take a deeper look at what transpired, why it is important, and—more importantly—how Google’s court victory has indirectly shielded Apple from a monumental headache.

The Battle at the Heart of Big Tech

The tech sector isn’t just about developing the next cool app, or launching the latest frontier of innovative hardware, or making waves in artificial intelligence. It’s also about legal battles, regulation, and billion-dollar lawsuits defining how companies are formed and operated. And for the last ten years or so, both Google and Apple have faced an unprecedented amount of scrutiny over their business models.

Google has been targeted repeatedly for allegedly dominating digital markets, including online advertising to Android apps. Apple has been called out, including in courts of law, for its App Store policies that some detractors claim are “anti-competitive” and that seek to lock consumers into Apple’s ecosystem of products.

So when regulators and courts take on one of these companies, they often are creating legal precedent that will be applied to the other. And that is exactly what just happened.

Understanding Google’s Courtroom Win

The case focused on Google’s Android app store policies. Several groups, including app developers and regulators, accused Google of imposing unfair terms and abusing its once-dominant position in the smartphone app ecosystem to suppress competition.

In the end, the court sided with Google, finding that the company’s policies were strict but not in the way that the plaintiffs contended were violations of competition laws. This was a historic win for Google—not just because they walked away without incurring the penalties of billions of dollars but because it defended the very business model that app stores operate upon.

Why Apple Should Thank Google

Here’s the interesting part: while Apple was not in the courtroom, the decision is clearly a win for them. Apple’s App Store model is very similar to Google Play, and for a long time critics have stated that both companies maintain a “duopoly” that penalizes developers and consumers alike.

If Google lost this round, the regulators and lawmakers would have had a lot of wind at their back to take on Apple’s App Store at the same time, potentially with more compelling cases. Instead, the ruling provides legal cover for Apple, and it becomes more difficult for regulators to argue that Apple’s model is inherently anti-competitive.

In summary, Google just provided a half a million dollars of settlement money for Apple’s legal headaches—law suits, penalties, and potential judicial or regulatory reform to some facet of their App Store model.

Ripple Effect for Big Tech

This ruling doesn’t just offer Apple a reprieve offering it the potential path for the precedent that could change the way future antitrust cases are litigated – with other massive companies, such as Amazon, Microsoft, and Meta, paying attention to the ruling as each operates platforms that allow for debate on access, pricing, and fairness.

With this ruling, acquiescing to Apple’s and Google’s defenses that add to their case and strengthen facts about companies that can argue:

– App stores foster security and quality control.

– Commission payment (such as Apple’s 30% commission) is deemed part of maintaining the ecosystem.

– Developers still had reach to a massive audience.

But Is the story over?

While Apple can take a small breath with the immediate relief, experts reminded that that doesn’t mean the pressure is off. Regulators in the EU, and arguably elsewhere in the world, continue to perform lots of maneuvered pressure with potential reforms under the Digital Markets Act (DMA) that will eventually push Apple and Google forever rude their way into offering viable alternate app stores and the ability to sideload.

Furthermore, the public continues to see divided firms. Numerous developers echo that system clearly favors large corporations and leaves smaller innovative firms edged out. So while this is massive win in the courts, that does not guarantee either Google or Apple escapes any relatively long-lasting peace.

An Unusual Alliance of Rivals

What makes this situation so interesting is the paradox of their relationship. Google and Apple are fierce competitors in smartphones, operating systems, and services. However, they also depend on each other a lot of the time—Google pays Apple billions each year to remain the default search engine on iPhones.
Because of the new ruling, Apple has avoided an arduous struggle in court for what could have been years prior to today’s (March 2023) ruling. Ironically, Google just did Apple a big favor—by not even trying.

At Last, The Battle Continues At no time is there a shortage of drama within the tech industry and in this case, there may have been a victory for one giant, but this victory resounds in the boardrooms of the tech giants’ competitors as well. Google’s courtroom win prevents Apple from going through a massive headache but it raises some very important questions.

  • How long can tech giants count on personal courtroom victories to protect their business models?
  • How long will the world’s regulators wait until they introduce stricter rules, irrespective of the outcomes in the US courts?
  • And most importantly, what does this mean for the consumers and developers who rely on these ecosystems in the first place?

Let’s leave Apple alone for the moment and they can take a moment to relax. One of tech’s biggest lessons we’ve all learnt is, in Big Tech, in even victory is short-lived and the next battle is always around the corner!
